Hill Más de una vez hemos visto en la gran pantalla como una turba enfurecida de vecinos asaltaba la prisión de un pueblo americano en el lejano oeste para intentar sacar por la fuerza a un reo con el propósito de ahorcarlo. Frases como "¡Hagámosle un juicio justo y después colguémoslo!" o del estilo, han sido tan protagonistas no sólo en los westerns sino también en las novelas y ensayos de la misma temática, que poco a poco han ido creando un mito sobre la extrema violencia de una sociedad debido a la ausencia de instituciones gubernamentales. Si a ello le unimos algunos episodios violentos dignos de reproducir en la gran pantalla o en los circos (a pesar de que no representaban las características generales de la sociedad del Oeste americano) solo se estará incrementando el mito de la anarquía como desorden violento y caos social. La rapidez con la que se extendían los ganaderos, agricultores o mineros a los territorios del Oeste era mucho mayor que la del sistema gubernamental americano. Y sin embargo, la producción y ejecución de leyes se llevaba a cabo por parte de los particulares. Las leyes privadas se aplicaron a través de los land clubs (o clubes de propietarios de tierras), las asociaciones de ganaderos, las caravanas que tantas veces hemos vistos en películas atravesar las praderas de los desconocido, o las empresas y explotaciones mineras que se asentaban en las tierras californianas en busca de oro. Los nuevos propietarios de las tierras fronterizas debían asociarse para procurarse la ley y para ello adoptaban sus propias constituciones según las preferencias de los integrantes de estos clubes y disponían de sus propios jueces y oficiales que se encargarían de llevar a cabo estas disposiciones. Los gastos del juicio corrían a cargo del demandante y del demandado. Una manera de hacer cumplir las reglas que este tipo de asociaciones ciudadanas extra-legales (por estar fuera de la ley estatal) disponían era la de no comerciar ni relacionarse con aquellos que decidían saltarse este tipo de convenciones. Otro modo de resolver disputas y conflictos era a través de sistemas de arbitraje, más rápidos y neutrales que los juicios estatales: como sucedía en las caravanas, en donde fácilmente surgían conflictos y disputas y donde leyes propias se pactaban voluntariamente antes de salir hacia las praderas americanas. En estos casos encontramos las mismas cualidades y beneficios que actualmente. De hecho, las conclusiones a las que podríamos llegar a través de recientes estudios bien podrían ser las mismas que en el salvaje oeste: flexibilidad, participación de las partes, irrevocabilidad de las sentencias, privacidad, grandes especialistas de prestigio (auctoritas en la materia)... y no es difícil pensar que en un futuro estos sistemas se perfeccionen y cobren mayor rapidez, sobre todo si tenemos en cuenta que más del 80% de las empresas internacionales prefieren este tipo de resolución de conflictos al de los tribunales estatales de justicia. Por tanto, lejos de ser una época y unos lugares en la que la ley de la selva imperaba, el lejano oeste americano da ejemplos siempre limitados (pues había un trasfondo gubernamental) de cómo los ciudadanos cobraban protagonismo y lograban organizarse para desarrollar leyes privadas guiadas por la costumbre, la c
